Terms of Service
Welcome to fink. By downloading, accessing, or using the fink ecosystem (including fink., fink.browser, fink.notes, and fink.chat), you agree to be bound by these Terms of Service.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and fink regarding your use of the software. If you do not agree with any part of these terms, you must immediately cease use of all fink software.
2. Decentralized Nature of the Service
fink is fundamentally a decentralized, local-first set of tools. You acknowledge that you are solely responsible for managing your cryptographic keys and data backups. fink does not possess your private keys and cannot recover your data, messages, or notes if you lose access to your primary device without a backup.
3. Acceptable Use
While fink provides absolute privacy, you agree not to use our software to:
- Engage in illegal activities under applicable international law.
- Distribute malware, ransomware, or malicious code.
- Attempt to reverse-engineer or compromise the cryptographic integrity of the fink ecosystem.
- Facilitate the sale or distribution of illegal narcotics, weapons, or controlled substances.
- Organize or coordinate acts of physical violence, terrorism, or extremism.
- Distribute, produce, or share child sexual abuse material (CSAM) or any exploitative content.
- Engage in targeted harassment, doxxing, or swatting campaigns against individuals.
- Defraud, scam, or phish users out of cryptocurrency, fiat currency, or private keys.
- Conduct illicit cyber-warfare, unauthorized penetration testing, or DDoS attacks against third-party infrastructure.
- Launch Sybil attacks or artificially manipulate the fink peer-to-peer network routing.
- Harvest, compile, or attempt to sell metadata or user activity data derived from network observation.
Note: Because fink cannot see your data, enforcement of these terms relies on community reporting and network-level consensus, rather than centralized moderation.
4. Restrictions on Reverse Engineering and Data Scraping
You are expressly prohibited, unless authorized, from reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code, underlying ideas, algorithms, structure, or organization of the fink applications, except to the extent that such activity is expressly permitted by applicable law or by the open-source licenses governing specific components. Furthermore, you may not use automated scripts, spiders, bots, or any other scraping technology to access, index, extract, or harvest data from the fink ecosystem or its infrastructure for any purpose.
5. Open Source and Licensing
Certain components of the fink ecosystem may be provided under open-source licenses. Your use of those specific components is additionally governed by their respective licenses (e.g., MIT, GPLv3). You agree to respect all copyright notices and licensing terms embedded within the software.
6. Export Control Notice
The fink ecosystem utilizes military-grade cryptographic software. By downloading or using our software, you acknowledge that it may be subject to export controls and regulations under international law. You agree to comply strictly with all applicable import and export laws and regulations. You are solely responsible for ensuring that your use of fink is legal in your specific jurisdiction.
7. Modifications
We reserve the right to modify these terms at any time. Significant changes will be announced via cryptographically signed network broadcasts within the fink application. Continued use of the software constitutes acceptance of the modified terms.
8. Limitation of Liability
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. IN NO EVENT SHALL FINK OR ITS CONTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY (INCLUDING DATA LOSS), WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
Furthermore, because the fink ecosystem is constructed upon a foundation of absolute, zero-knowledge mathematical encryption, we possess no technical capability to monitor, censor, or intervene in user activity. We operate solely as neutral architects of these cryptographic protocols. Consequently, we expressly disclaim any and all liability for the actions, communications, or data transmitted by users utilizing our applications. You bear sole legal and moral responsibility for your conduct within the fink ecosystem.
